More details to this question:
Police gave no warning of stalled car at the bottom of the hill. It was to late when I popped the hill I had to take the ditch. No flares no blinking lights were in the highway.

We need a lot more information to determine whether you have a claim against the police department. Often times, cities, towns and counties in Virginia have immunity from liability in tort matters, especially if the the incident occurred while the police were performing governmental functions.
