QUESTION

Do I have a case?

Asked on Jul 23rd, 2015 on Personal Injury - Ohio
More details to this question:
A 100lb pitbull living next to us was loose. We were taking one of our dogs and our 9 year old son back in the house. The dog forced his way into our house where our 6 and 13 year old sons were and killed our 2 year old pomeranian in front of all of them. The renters do not have insurance, the property owner refuses to give us insurance info, and everyone is telling us to persue legal action. Is this personal injury?

The loss of the Pomeranian -- under Ohio law -- is the same as any other property damage claim. Unless your sons are seeking emotional therapy for what they witnessed, there is likely no other claim of any significance. You should call the police and report the incident. If you are dealing only with property damage issues, then there is not a claim of significant value to involve an attorney.  You could file a small claims court action; collecting any judgment wuld likely be difficult.
