Do I have a case for having a bad hand even after surgery?

More details to this question:
I fell on December 22,2012 at my trailer court. I broke my hand. I had to have surgery and the doctor placed a metal plate and screws in my hand. Recently, I had to have the metal plate and screws taken out of my hand cause I couldn't bend it right. I still can't bend it right and I can't write good no more either. I also lost 2 jobs cause of my hand being messed up. I don't want to get in trouble and I don't want to get kicked out of my trailer cause me and my family have no where to go. I need some advice and I need a way to get another job. I don't have any money at all .

If you can prove that the surgeon committed medical malpractice, then you can sue the doctor. However, if the actual accident CAUSED the problem and he did the best he could and you just have a residual problem, then you cannot sue for malpractice. If you can prove that the trailer park violated a duty owed to you, to provide you with reasonably safe common areas. and that was the direct cause of your accident and injuries, then you should sue the trailer park.

Medical malpractice cases are extremely difficult. The only way to answer your question is to have your hand and your records reviewed by another hand specialist. No attorney will take your case without that review.

Your question about your hand is a medical question. I doubt you have a claim. Perfect results are not required, but if you have a question you need to find a doctor to revive your medical chart and answer your question.

It is common that screws and plates need to be removed from a fracture site. There is no guarantee that the surgeon would have been able to repair the hand, particularly since we don't know how bad the fracture was to begin with. Also, accidents which cause fractures often cause other injuries as well, such as a tear of the "TFCC" which is connective tissue that holds many small bones in place. So, on the information provided, there isn't anything to indicate malpractice to me. Only if another doctor says that the surgeon made a mistake would you have something to go on.

You can only sue the trailer court if they were negligent. What did they doe to cause you injury?

I don't know who you want to bring a case against. I can't tell if the owner or manager of the trailer would be liable because you do not state how the accident occurred. You would have to prove that the fall was caused by the owner/operator's negligence. If you are thinking of sung the doctor, you would have to prove that the doctor was negligent.
