QUESTION

Do I have a claim?

Asked on Jun 11th, 2018 on Slip and Fall - Florida
More details to this question:
Was walking around building to find front entrance. Walked behind building (where there was additional parking), and tripped over loose cement between sidewalk and parking lot. Fell on right arm, fractured ulna and radius, and tore ligament on right elbow. The business says they have no legal responsibility because I was behind building, it was daylight, and it was clear to see. Do I have a case?

Yes , You have a case. Hopefully, you can hurry back there and take pictures before they repair it. Their defense will be open and obvious, but that still doesn't excuse their duty to make the necessary repairs to eliminate the risk. Another issue was whether the sidewalk was government property or private property. Retain counsel to investigate and take the case on a contingency fee basis. Yes - you have a case though the open and obviousness of the concrete may be a defense for them.
