Do I have a valid claim for a suit?

My daughter is 1 and has Sickle Cell SS. She's prescribed an antibiotic for daily use. The pharmacist gave incorrect instructions as to how much to take and my baby took 5x the amount originally prescribed. The excess amount caused diarrhea and dehydration which brought on a pain crisis. She's taken the medication for about 2 weeks and has complained of stomach and limb pains. After taking her to her PCP, them performing an X-ray on her arms that she felt the most pain in, it was determined that there were no fractures and that the pain was most likely due to a pain crisis. They also confirmed that her hemoglobin had dropped significantly. I called the hospital and asked them to confirm that they changed her dosage on the antibiotic and found out that they did not and that the prescription was filled incorrectly and the pain that my daughter was having been probably due to the medication. She is now in the hospital receiving liquids and pain medications to help deal with the pain crisis. Do I have a case? I've been contacted by the pharmacy who is acting nonchalant about the ordeal. Any tips?

The facts do justify a consultation with a medical malpractice specialist, to determine whether or not you have a claim which can be pursued against the pharmacy. I do not think this is the type of case you would want to handle on your own, as malpractice law has many technicalities that can easily defeat your case. Many lawyers, including myself, offer free phone consultations. An initial phone consultation is useful for a lawyer to gain additional facts to evaluate your case. A consultation will often allow a lawyer to gain sufficient information to give meaningful initial legal advice.
