Do I have any standing ground here?

More details to this question:
my son was in a car accident with his mother (we are divorced for years now, I have sole custody). He required medical treatment and after PIP and health insurance adjustments I still am on the hook for 2300+. The mother at the time was driving with a suspended license. I've tried to set up payment plans with her to cover the balance but ignored. Is this something I can take to Small claims court.
