My brother had a fender bender and was charged with DUI. The person he hit wants $50,000. He was told by his insurance company that (a) they would handle but in same letter told him (b) he should get attorney. We are afraid if the insurance co does not handle the person hit will sue him. He has no money to speak of but his name is on the deed to his house along with mine. He has lawyer for DUI case but they said they did not handle this kind of case. If we need to get lawyer for this do we need to do it now or wait to see how insurance company handles? Why should we need a lawyer? Should we take the house out of his name?
There is no situation in which your brothers insurance company is being sued for 50k. Florida simply doesnt allow this type of suit. Depending on the injuries suffered, there is a clear possibility that your brother may be sued or ask to contribute in excess of the policy limits due to the DUI. He would be wise to retain counsel to address this as 50k is a faily low amount of insurance if the other peopel were hurt even moderately.
