I was in a rollover accident when my breaks on my co. truck failed. But two week prior I smoked pot at a super bowl party.

I would not pursue the matter without counsel, but if you were still employed and the injury occurred in the course of your employment without anything at the time that would raise questions, then the events of a few weeks earlier should not negate the claim.
