Do we have a case if my mother died using a faulty pacemaker?

More details to this question:
My mom had a pacemaker installed around 2003. Every time her pacemaker was checked it always read it was never used and the battery was never used. Anyway, her pacemaker never kicked in and she died in 2008 at age 62. I could never understand why her pacemaker never kicked in when she had her last heart attack. I know the brand she had was the same brand name as a recalled one, but of course there are different models. I am just wondering if her death could have been prevented. I feel that the pacemaker never worked but that is just my opinion.
