QUESTION

Does age of at fault driver determine settlement value?

Asked on Aug 08th, 2012 on Automobile Accidents - Texas
More details to this question:
I was involved in an auto accident 5 months ago. The other driver turned in front of me while I had the right of way. He admitted his fault to turning on yellow thinking he had more time to make the turn and I hit his car. Police report states this also. No ticket issued but he got a verbal warning from officer. He was 4 months away from his 90th birthday and got out of his vehicle using a walker. Does this have any bearing on his insurance giving me a fair settlement? He was fine but I went to the ER with abrasions to my face and neck/back/shoulder pain. My 11 year old son in the back seat was not injured either thank the Lord. I was just released from the ortho doctor after 8 weeks of physical therapy and home therapy. Nothing broken but I had bad neck and shoulder strains. Thanks for any info. you can provide.

The age of the driver who hit you, by itself, shouldn't have any bearing on the value of your case.
