QUESTION

Does my Son have a case?

Asked on May 14th, 2024 on Automobile Accidents - Maryland
More details to this question:
My son is 23 yrs old and was headed to work and was in the lane turning with his turn signal on, he noticed a truck coming up behind him quickly and it was not slowing down at the last second he braced for impact and was hit from behind at about 40-50mph and was shoved into on coming traffic which he was able to avoid. He thankfully was ok but is going back tomorrow am to the er to get X-rays as heโ€™s now having pain in his neck area. The driver was a county sheriff and only hit his brakes at the very last second, from the officers demeaned and the supervisor that I spoke to itโ€™s obvious he was on his phone. The supervisor who I know said well someoneโ€™s getting a new vehicle out of this. I believe he has a case to at least get a new vehicle and some type of settlement as the officer was so negligent in this case.

If he was injured he would be entitled to compensation for his medical bills, lost wages and pain and suffering.  You mention that he has neck pain.  That most certainly an injury, and with the force of this impact, I would highly suggest that he follow-up with an orthopedic surgeon, and get fully examined, since these injuries can be serous, and long lasting.  I would also suggest he contact a lawyer who concentrates his practice in personal injury, to make sure his right rights are protected.  The intial consultation is free, so there is no risk in him calling.
