Failure To Protect Disabled Man Under Protective Custody

I am a permanently disabled man with a number of chronic conditions. The charges in my alleged offense were eventually dropped. During my 18 month detention I was placed in Protective Custody, allegedly for my protection. This involved placing me in a three man cell, designed for two inmates with "inmates known to be dangerous.' This included numerous younger inmates who had charges for murder and assault. I was assaulted several times by youthful offenders. One assault occurred before transport to court. I was cuffed to another inmate, and another inmate, with a history of violent behavior and assaults, who was roaming the area without any restraints, assaulted me in the face. Transport officers subdued the inmate, and I asked to press charges. A CO made a note of my desire to press charges, and I was seen by a nurse. No follow-up investigation was ever done. I have seen federal case law originating in FL, where lawsuits where won in cases where there was a failure to protect.

Its possible - just a not a generally desireable case for civil damage for a variety of reasons starting with being incarcerated. As such unless the damages are substantial, approaching catastrophic, ala paralyzation, death, etc., you may need to hire a lawyer out of pocket to have them pursue such a case.
