A few days ago while walking up the stairs in my apartment building I fell/slipped. I use both hands to catch myself. After a few days my left hand is in good shape can do normal day to day activities. My right hand not so much (currently at Mount Sinai getting X-rays) my building has several open violations for the stairs which is; June 2020 (2018, 2017, 2016) Violation Class A Section 27-2005 ADM CODE remove the torn and/or loose floor coverings from public stairs at all stories. The non slip rubber is worn and exposes the metal stairs. The management team used black spray paint every so often to cover up the defects. I have documented and taken pictures of the stairs. Should I contact the management company first or should I have an attorney make the first official contact.
Mr. Boria, have an attorney make the first contact. The building will not take your case seriously if you do not have an attorney. Nor will the building's insurance company negotiate with you in good faith if you're representing yourself. That the building was issued violations related to the stairwell may or may not be relevant depending on whether any of the conditions for which it was cited contributed to your fall. In other words, if you fell because of a torn / loose floor covering, then the violation would be relevant. If, on the other hand, you fell because there was water or debris on the stairs, the violations would be irrelevant.
