I have insurance and a valid license. When I bumped into this guy he got out and we talked on the side of the road. His bumper had a few small, but deep scratches and my car was dented and had a hole in it. He said he didnt want to have the police involved but he wanted something b/c he says it was my fault and i should pay for the damage. At first he was asking me to send him $100 in the mail but now he wants to have our insurance handle it. is this possible without filing a police report?
Yes, an insurance claim can be made without a police report or the police reporting to the scene. And, under Ohio law, you have a duty to provide your insurance information to him. If you refuse, he could end up filing a lawsuit against you. You should probably contact your insurance company and let them know about the accident immediately. Most policies require that you notify them of any accident as soon as possible after the accident. And you should probably follow their advice as to how you proceed from here, so that you dont violate the terms of your insurance policy.
Best of luck.
