My shower fixed shower wall panel exploded while I was showering. There was no impact. It was totally random. Needless to say, I was covered in glass with several cuts in my skin, including a piece of glass stuck in the bottom of my foot. There was blood coming from several parts of my body. The glass pellets flew all over the bathroom, with many of them flying off and ending up embedded on the walls of a wood cabinet. I was barefoot as I was taking a shower and couldn't use the wounded foot. I told my husband to call 911, and I was taken to the ER where a piece of glass the size of a dime was taken out of my foot. My wounds got cleaned up, got 3 stitches on my foot, antibiotics, a walker and was sent home. What do I do now? This was such a traumatic experience. The original installer is coming in to our house (we own) in a few days and I don't know what my rights are (if any) here in South Florida. I am minus a glass panel, injured, traumatized and with hospital bills as a result
It sounds like you have a case against the original installer for faulty inspection or faulty maintenance which forseeably and proximately resulted in injuries that could have been prevented.
Unless you can establish, likely with an expert, how and why the glass shower panel would "explode" with such force as to embed pieces in the wall, you likely won't have many "rights" assuming you mean that in the context of holding someone else legally responsible and providing you money compensation. Unfortunately, absent some clear and credible explanation, Occham's Razor is the rule, that the simplest explanation is typically the correct one, where it will be assumed you or someone did something to the glass wall to cause that to occur, whether it was a slip&fall in the shower, hitting the glass inadvertently with an object, etc, as its rare that a glass wall would simply denotate out of the blue. I would suggest an independent review of the glass by another glass installer or glass expert/engineer to get the answers you seek.
