A minor hit my parked vehicle and it turns out the owner of the car the minor was driving was her aunt with no insurance . We went to go ask if they were going to pay for damages and the owner said no cause she is only the owner and her niece was driving it not her so she won’t pay for anything. Should or can we take the aunt (owner of car) and her niece the one in the hit and run to court we have witness who saw the accident and her take off
Yes. The owner of a vehicle is liable under Texas law if they “entrust” their vehicle to someone who is unlicensed or incompetent to operate a motor vehicle. This is know as negligent entrustment.
