How can I file a lawsuit against Chuck E Cheese's?

More details to this question:
My daughter slip and fell and had to be taken to the hospital for an emergency cosmetic surgery! She got 13 stitches and is left with a scar on her face forever! I have medical bill for the procedure which Chuck E Cheese's promised to take care of but haven't! I have been unable to get in touch in them for about four weeks now!

I would need to know more information to determine if a suit against Chuck E. Cheese is feasible. Chuck E. Cheese would need to be negligent in some way to bring a claim for medical damages and/or pain and suffering.
