How can I get a worker’s compensation if my boss doesn’t want to?

I twisted my ankle at work and I was sent home. I think it may be broken.

WHY do you care what your boss wants? He has NO say in this matter. If you file that's his problem. NO BOSS wants an employee to file. TOO BAD BOSS.

They are required to file the claim or you if you are injured at work. You may need to speak to a workers compensation lawyer.

If the injury arose out of and during the course of your employment you are entitled to worker's compensation. If you boss will not acknowledge the injury, you may need to file with the worker's compensation bureau. It would be to your benefit to seek the advise of an attorney who understands worker's compensation.

Answer: You report the injury in writing and then if he doesn't respond you call the Iowa Industrial Commission, ask them to intervene to contact the employer asking for him to provide the contact information for his workers' compensation carrier and hire a lawyer to file the claim.

Contact a worker's compensation attorney in your area. You should be able to get a free consultation. Your employer has no choice in the matter as it's your right to file a claim. If he does not have coverage like he's supposed to, the lawyer can guide you on your options.

He doesn't have a choice. You are entitled to worker's compensation as a matter of law. The employer must post information about worker's comp at the workplace, including contact information for the insurer. Get the information, call the insurance company, find out what forms you need, fill them out and send them in. Get the treatment you need.

Go straight to your family doctor or to the ER and have your ankle x-rayed. If your boss is playing games with your safety call the NC Industrial Commission in Raleigh or go to their website. File a form 18 (I think that is the number) which is a notice of your claim. File it with the IC and send your boss a copy. If you have a serious injury get you a good PI lawyer.

Your employer is required to report this to its workers' comp carrier. If you go to the doctor and tell them it happened at work, he or she is also required to report it.

Does your boss have workers compensation insurance? If not, the company is normally liable to pay the damages and it is strictly liable, there is no defense available. You should contact an attorney to discuss this matter.

Call the department of labor in Helena MT and report the injury and make a claim. After that, make an appointment to see your regular doctor or a now care doctor and have the injury assessed. Don't go to the emergency room.

If the boss or HR will not process your claim, you commence a claim by filing a form 50 with the Worker's Compensation Commission. You can find their Website on the internet.
