How can I make sure that I win the following case...?

More details to this question:
My car was involved in an accident, it was being driven by a valet. My insurance company sent me a letter saying that they are not responibie for any damages. The driver of the other car is suing me for the damges to his car. In the police report the valet states that he was merging onto a main street when the other driver , driving at a high speed hit my car. There is a witness who makes the same statement in the police report. Is the valet company responsible for the damges? What steps can I take to make sure that I win this case?

In NY the owner is usually responsible for the actions of the driver when the driver is driving with his permission.  However, a valet assumes legal responsibility for the use and operation of the car when it's in their care and custody so they are responsible.
