Before filing a lawsuit over the total loss value of your vehicle, you should try to work this out with the insurance company as it will take time & money to litigate this matter. If you believe your vehicle is worth more money, than you need to provide written documentation (e.g. comparable vehicles being offered for sale, a quote from a used car dealer as to the value of your vehicle) as to why you believe your vehicle is worth more money than the insurance company is offering.  Good luck with this matter.
