QUESTION

How do I handle a he-said-she-said accident case?

Asked on Apr 08th, 2015 on Personal Injury - Georgia
More details to this question:
I was parked. A vehicle pulling a utility trailer parked next to me. When I came out to get into my vehicle, I opened my door to get in. The vehicle pulled away and my door went with it. I was an eye witness but his insurance didn't pay, mine did. I am totally blown away. He was not looking behind when he pulled out or he would have seen my car. I did not see a driver in the vehicle. The windows were tinted.

You can sue the other driver in small claims court. Most larger counties in Georgia have Magistrate Court for this purpose. The largest amount you can claim in Magistrate Court is $15,000. Of course, the dispute before the judge will come down to he-said-she said. The goal is for the Judge to evaluate your story as more believable, given the circumstances. Unfortunately, attorneys do not generally get involved in these cases, especially on contingency liens. I hope this was helpful, and good luck.
