How do I know if I have a case for personal injury due to mold?

Mold was discovered in my apartment a week ago and supposedly treated. The mold issue has since gotten worse. I am attempting to break my lease because I work from home and have been breathing this toxic air 24/7. The health department has been contacted as well as code enforcement. I am also sending off a home mold sample to be analyzed professionally. I am thinking of seeking legal council because I believe the apartment community knew this mold existed in my unit before and did nothing about it. Would I have a case?
