QUESTION

How do I request a settlement funds early for hardship?

Asked on Jul 08th, 2016 on Personal Injury - Wisconsin
More details to this question:
Long story short, my daughter's mom was killed in a car accident last January and we were exiled from the area. My daughter chose to cut the ex-boyfriend out of her life and the family thinks we coerced her. We had nowhere to go after our lease was up but to stay with a friend in another state. We have our stuff in storage and are applying for jobs. My unemployment is under review for being laid off. Our car payment is in default and about to be repossessed, phones about to get shut off, and we've tried getting assistance out here. Can I request enough to get into an apartment and pay up the car to get on our feet?

You can request anything. The problem is that if you make such a request early in the development of the claim, the insurer will know that it can settle cheap. That may not be in your best interests. But if your needs are as great as you describe, then you might take the risk so long as you are certain that the facts demonstrate that the other party was at fault. Your child may have an insurable interest in your mother's life, but unless you are named the beneficiary or are married to the mom, you might not Your best bet is to consult an experienced personal injury lawyer in the locality where the accident occurred. I am sorry for your loss.

Not likely if a settlement has not been agreed upon.
