Want to sue a huge company for negligence but have no idea how to start the ball rolling.

If you are suing a huge attorney and you think you are entitled to more than 7,500.00, call an attorney for help. If you think the case is worth 7,500.00 or less, go to small claims court. They will assist you in filing a suit on your own.

If you are going to try to do it yourself, without the assistance of counsel, you will likely have your hands full. But the initial step that starts the process is usually the filing of a Complaint and Summons. Sometimes there are preliminary steps that are necessary (such as a Tort Claim Notice within 180 days if pursuing the State of Indiana or any governmental entity in Indiana). It's a complicated enough process that you should seek counsel from a personal injury attorney in your State.

Start by contacting an attorney. Unless there are minor damages and you can pursue in small claims, you will need help. Otherwise, you simply need to draft a summons and complaint and file it with the secretary of state for service upon the corporation. If there are serious injuries, go get an attorney immediately. If everyone could do this stuff, we'd all be out of business. Good luck.

Your first step should be to seek out an attorney that handles cases like the one for which you want to sue. Especially when seeking justice against a large corporation with the resources to defend itself, you need an attorney competent to the task.

You shouldn't try to sue a large corporation on your own. Obviously the company will have several attorneys to defend it. You should consult with an injury attorney to find out if you have a case, how strong of a case you have and what is involved in suing a corporation. Injury attorneys typically will meet with you for free to evaluate your claim. Good injury attorneys go against corporations both large and small of the time. Since injury attorneys typically don't get paid unless they make a recovery you have a chance to go up against the biggest entity. If you had to pay by the hour it would be cost prohibitive for most of us to sue a big company.

You start that process by hiring a lawyer not by going on the Internet and asking where do I start. Suing a large corporation with a legal department isn't like driving a car to the convenience store. It's much more complicated than you think and no matter how mad you about what you think they have done anger alone won't teach you what years of practicing law does. So go hire a lawyer.

In case you have not read newspapers or magazines in awhile, the world today is much different than it was 30 years ago. Suing a major corporation for negligence would probably run several hundred thousand dollars of attorney time and expense. If you want to have a contingency fee lawyer evaluate the case, do so to get some perspective. The Courts today are engulfed in a love of businesses over people. Jurors are unwilling to grant damages as in years past. Winning any case in court today is difficult but a big case against a major corporation will likely be a 3 to 7 year Endeavour.

You will need to visit the Secretary of State's website and find out what the legal name of the company is. Many companies' legal names are different from their trade names (the name on the sign). They will usually be listed as "XYZ,Inc. d/b/a ABC, Inc." Once you have the right name, you prepare a Complaint outlining your allegations, file it, and serve a certified copy on the Registered Agent of the company. This person will also be found on the Secretary of State's website. Good luck.

There are two things you have to do. First is to provide a lot more information e.g., what happened that you claim there was negligence, what the negligence did to you, what evidence you have, when it happened, what investigation has been made so far, out of pocket expenses, permanent injuries would be a start. Second is to get a lawyer. Whatever you think the problem is, this is not a DYI project.
