How long is the jail time for juvenile battery charge?

More details to this question:
I was in school when me and this girl was flirting. She took my pen and put under her but I grabbed it from up under her legs and now we have to go to court will I get jail time? This is my first offense.

Who charged you with battery? The girl? If so, you are in trouble because you actually did touch her without her permission. If it was a third party (teacher), the case will depend on what the girl says under oath. I think that you need a lawyer. If all of the facts come out, and they are exactly as you have told me, the judge would possibly throw the case out.

I cannot say what sentence you will get. It sounds like a likely case for probation, but you can get jail time.

Depends on ages of the parties. If she is below and you are above you could have a problem. Suggest you get the best lawyer you can find.
