How much will I get for my work injury?

More details to this question:
i got hurt at work 3 yrs ago. 2/17/2009. i tore cartilage in my left shoulder and pinched a nerve in my neck. i've had four surgeries since. two on my left shoulder and two on my cervical spine. i also had an emergency mri yesterday to see if i need another surgery. is there a set amount that i will recieve for being injured?? and are there two seperate payments i will recieve since there are two diff body parts, the shoulder and spinal chord???

I cannot answer your question without more information. How did you get injured? Did you become comletely disabled or were you able to do any kind of work after the injury? If you can work now, how long were you completely unable to work and how much less you are earning as the result of your partial disability? Did you file any claims with any insurance carriers, including New York State Workers Compensation Board? Did you receive Social Security Disability payments or payments under New York State Disability Program? Who paid for your medical treatment and medications? Answers to these questions would help to determine whether your injury comes under the Workers Compensation law. If it does, the most you can get is weekly payments equal 2/3 of your wages prior to the injury but not more than $550 a week. Additionally, you might get some Social Security Disability benefits. Your medical expenses related to the injury should also be covered. But you will not get any lump sum compensation. It also does not matter that 2 body parts were injured - only the degree of the resulting disability.

Since you have a permanent injury, you can get a "schedule award" which is based on a formula depending on the extent of your disability. Since it was one accident, everything will be combined into one proceeding. But: you should get some advice as to whether the schedule award is your best option. Depending on your situation, you may be better off getting disability payments and having your medical expenses taken care of.
