How much would be a fair settlement offer from a car accident?

More details to this question:
I have neck and shoulder injuries that have kept me off of work for more than 6 months. Mainly muscle and soft tissue injury, but has been very painful and very limiting. I am still receiving physical therapy and only working three hours a day at a limited capacity.

Almost every day we get a request for evaluation of a claim. We cannot respond to such a request, as there are simply too many elements to be considered. These include percentage of fault, age and health and background of the claimant, the nature of the injury, the treatment, the diagnosis, the prognosis, the cost of the treatment, and the outcome. Also to be taken into account in some cases are the amount and type of insurance coverage and the name of the company. Most attorneys offer a free conference. We suggest that you talk to a few lawyers. Also, you should know that an independent study showed that claimants did better, even after fees, with a lawyer than without.

If you have been in an accident with treatment over six months, it will be important to look into the residual effects of the injury. Did you have an MRI of neck and shoulder? Is there any positive findings? Have you seen an orthopedic or neuro surgeon? has any insurance paid any of your medical bills? How much are your medical expenses? Have you been authorized by a doctor to be off work for all this time? Is the authorization reflected in your medical records? Did you have any pre-existing injury? How much is the other party's insurance coverage? We need answer to all these questions, before a fair value can be determined of your case value. Please feel free to call us if you need to discuss.

A fair settlement in a case with clear liability and causation should include the amount of income you have lost due to your injuries, the medical bills related to your injuries, and compensation for the pain and suffering you have experienced.

Your case is worth what you can prove to a jury as your damages. Soft tissue cases, without positive medical tests to support them, are not very big usually.

It would be impossible to make a reasonable estimation given the limited information that you have provided. You are very foolish to an attempt to evaluate this yourself or over the Internet on such limited facts.
