QUESTION

Hurt leg-- collapsed stairwell

More details to this question:
I'd like to know if I potentially have a case worth perusing. I recently fell and hurt my shin from a collapsed step at my apartment complex. It was the third step up from the ground. It appears as if a metal bracket rusted out causing it to fall--it collapsed the moment i stepped on it. I have plenty of photos documenting this. I reported it to my leasing office where they had me fill out an incident report so I am currently waiting to see where it goes next. As far as my leg, I had about 2 scrapes and some pain. It also feels like I have a dent in the spot where I hit it. If my leg is deemed "okay" from a doctor, will I have any form of a case? I will be visiting the doctor tomorrow to get it checked out. Also, this happened only days before me moving out of this complex so it made this process a little more challenging. due to this stairwell being out of service, my moving company was forced to use the back stairwell, which probably added time to the cost (Hourly). Thanks.

While your claim appears to be a valid one, the damages are too low to justify retaining an attorney. Use your health insurance and follow up with management to obtain contact information for an adjuster. It is even possible that they have "no fault" coverage for medical payments which would reimburse you personally for whatever your own insurance pays. God Bless, Jan
