2 years ago I worked for a security company that was contracted at a major clothing store. Myself and a manager for the store was escorting a shoplifter to the back. The shoplifter pulled away from me and ran towards the exit. I took off after him and accidently ran into the manager knocking him down. Now 2 years later I get a call from the security companys lawyer saying that I will be asked to give a deposition from his attorneys and that she wants to meet with me to go over the details. My question is should I retain my own lawyer to go with me. Should I even be meeting with her first and can I be sued personally. I quit the security company shortly after the incident but not because of it.
It appears the store manager is suing your former company for the injuries you "allegedly" caused. I strongly recommend you cooperate with the company's lawyer. They are their to help you. In fact, if the store manager sued you, that same lawyer would be defending you as well, since your former employer is financially responsible for anything you do while in the course and scope of your employment. Even if you were sued, plaintiff's lawyer is not going to try to collect from you if they can collect from the security company. Under the facts as you explained them above I highly doubt you need your own lawyer. Call the company lawyer and work with them. Good luck.
