i fell down the stairs at The House Of Blues, at the hospital they xrayed my feet the doctor report said i have ,CLOSED AVULSION FRACTURE OF MY RIGHT AND LEFT ANKLES,INITIAL ENCOUNTER. I am still in pain, and it has been 4 months, my lawyer said he in so many words that he is dropping me after 4 months and he didn't tell me why so i don't even know if i have a case anymore i wish some one would get back to me and let me know what i mean by that is i have already contact another laywer and he didn't get back to me. so if you could tell me me i have a case and if i do can you please help me Respectfuly Dianna Garcia
Hi Diana..This is a guess, but usually, lawyers drop cases when either no insurance coverage exists, no real injuries occur or where liability is lacking. The first two dont apply as you suffered a real injury and the House of Blues must have excellent insurance coverage, which leaves the third reason. My guess (and its only a guess) is that counsel felt that liability does not exist.
In order for a propery owner to be liable for this type of fall, they have to be on notice of a dangerous condition on their premises that they should have forseen could cause this accident and also that they failed to take steps to remove that dangerous condition. What caused your fall? Was there lack of lighting? Were there no handrails on the stairs? Had you been drinking? Were you wearing high heels?
