was totaled the person who hit me is only willing to pay 4000 dollars and I owe 12000. I had just turned 18 and was unfamiliar with insurance law shouldn t I have been advised by the dealer about full coverage? It seems evident that the person responsible doesnot have the money to pay to buy me a new car should I sue him anyways? It is not right for me to have to pay 12000 dollars to the dealer for a accident that was not my fault.
To be candid, if you are 18 and dont know what you are doing, you had no business buying a car or engaging in such a transaction and did so at your own peril. Legally, you are an adult and responsible for your own decisions. Other people, and particularly people selling you things, are not obligated to educate you to make a good deal or even a proper one. This has been reduced to an old latin saying "Caveat Emptor" or "buyer beware". Whether you think its "right" or not, you are responsbile for the loan and the car, and if you did not have insurance and the person that hit had no money, sadly you just had a very expensive lesson to learn about protecting yourself and purchasing insurance.
