I was rear ended while sitting at a light

More details to this question:
It has been 9 months, I was still trying to settle car and think about lawsuit due to back issues, chiropractor, physical therapy etc. Unfortunately her insurance company is going insolvent. Do I lose my chance to sue?

Dear Shermeen,   Just because the at-fault driver's insurance company is insolvent does not mean that you don't have a chance for recovery.  However, it can make settlement of your claim more difficult, and your recovery may be limited. You must file a lawsuit within two years of the date of the accident, or you risk forfeiting your claim altogether.   Chip Clark
