I am a S.C. lawyer and board certified internist, but my answer does not create an attorney/client relationship, nor do I solicit clients. More detail is needed. If the children's names are on a deed, the property belongs to the children and whomever else is on the deed. The family court can arrange for the appointment of a guardian to act as trustee for the children until they reach the age of majority, which is 18 in S.C. Child support is calculated based on your net worth. The proceeds from an auto accident would be part of your net worth. A divorce has nothing to do with child support. These are your children, and you should be happy to provide for them. Children are a blessing from the Lord.
