My wife has been in an accident and my daughter and she were injured. The car was totaled, airbags deployed, they were taken to hospital by ambulance. Both had medical bills more than $2300 each. I had liability insurance so I negotiated with the other side's insurance. They accept full liability. I have made a claim for "pain and suffering" for my wife and daughter and asked for 40,000 for both. They said they will only pay 2,500 for both (1,250 each). I think we deserve more. I want to sue the insurance company. If I hire a lawyer to directly sue the company, will they have to pay for my lawyer fees too?
You most likely would not be suing the insurance company. You would be suing the party responsible for your accident (driver and/or owner).
