I was coming home in a snow storm hit a pocket of slush and was pulled into my neighbor’s car that was parked on the road two driveways from my house. It was 2:00am and all of their lights were off so I decided to talk with them in the morning and make arrangements to fix their car then. Before I was able to do this a cop showed up at my house and accused me of a hit and run. I told the cop that I was planning on dealing with this in the morning and that it was clearly obvious that it was me since we live on a dead end road and there are tracks leading right to my house. The cop said that I will most likely get charges in the mail for a hit and run and that I am lucky for not getting a DUI. After the cop took my insurance information and left, I went to the neighbor’s house explained what happened and then cut them a check for their purchase price ($3,000) of their vehicle that I hit.
Police have a lot of discretion in charging people with crimes. You may get cited with Damage to Unattended Vehicles. Your story may be a good defense. The fact that you paid the neighbor's damages is a huge factor in that they will be less likely to prosecute. However, in order to assure this case is handled in a way that leads to a withdrawal or a dismissal, I would hire an attorney.
