Anyone responsible for an accident has to pay all reasonable damages he causes. In your situation, the person you hit got paid for his damages by his insurance company. In that situation, his insurance company can come after you for reimbursement for what they paid their insured for his property damage/loss. This is known as subrogation. All insurance companies have in their policies the right of subrogation. Because the insurance company now stands in the shoes of its insured, all defenses available to you as against the insured are available to you as against his insurance company. In other words, the insurance company still has to prove you were at fault. If you can prove you were not at fault for the accident, then you do not have to pay the $13,000.00. If you feel you were at fault, then try to negotiate with the insurance company to reduce their claim against you. Good luck!
