Hi, so on Christmas day I got into a car accident on the highway. I was attempting to merge into the middle lane but I missed a car due to my blind spot. When I saw the fast approaching car, I attempted to merge back into my lane. Due to the sharp action I took, the steering wheel locked and I started swerving. I avoided hitting any cars but instead I hit the median and my car flipped 2-3 times before landing and kicking the back wheels to each side due to the impact. I found out a week later that one of my wheel apparently rolled across the lanes and hit a car. The car didn't stop at the scene of the crime, instead kept going and later reported that my wheel hit it and caused $1500 worth of damages. I had no car insurance at the time so that money is coming out of my pocket. I was wondering is there anyway to fight the charge. It was out of my control that the wheel hit him, I did all I could to not hit anyone. it's not my fault that the aftermath caused an accident, is it?
"it's not my fault that the aftermath caused an accident, is it?" ....why on Earth would you think this? If not your fault, whose is it? Of course its your responsibility for not controlling your car. The steering wheel didn't "lock up" (unless you have a mechanical expert that will testify to such) but rather it is morelikely you over reacted to your negligence on not making sure the lane was clear when you changed lanes, over corrected your steering to the left and sent your car into the median where if flipped. Thankfully you were not catastrophically hurt nor was anyone else, but the fact remains that you are responsible for ALL of the effects of your negligence.
