During the rush hour all three lanes were going the speed limit (me as well). When I was changing lanes, I turned my signal and checked my surroundings to make sure no one was on my left side. I proceeded to change lanes once it was clear, all of a sudden I hear crashing noise and I got back to middle lane. Out of nowhere the motorcyclist was on my left side and obviously he was going above the speed limit. When he bounced of me he also hit another car. The witnesses were saying that he was going at a really unsafe speed and changing lanes really fast. Later the cop cars and ambulance showed up. The police officer gave me a ticket and told me that he doesn't want to give me a ticket but because of the law it looks like it was my fault. I found out through my insurance company that he got a lawyer now and my guess is he is going to abuse the law and ask for a lot of money. How can I prove he was endangering himself and others with unsafe driving. Any help will be greatly appreciated.
The failing in your position is a classic one - they other driver I didnt see and collided with must have been speeding - which begs the queston of how could you possibly say such thing with a straight face when YOU were changing lanes UNLESS you admit you saw the other driver and pulled in front of them anyway. In your situation, if you have the ID for witnesses saying the bike rider was swooping in and out of traffic at high speed, provide this information to your insurance defense lawyer and they will address that.
