QUESTION

Inquiry into accident

Asked on Apr 04th, 2014 on Automobile Accidents - Washington
More details to this question:
Basically when exiting my apartment building. I scraped a car parked right at the edge of the driveway making a turn when oncoming traffic forced me to turn into it. The rear passenger side door scraped their bumper creating scuff damage. My car got a gash. Left a note, and my insurance sided with them. However, the car by Seattle law was parked within 5 feet, in fact like six inches into the driveway!. Which I think is illegally parked. My question is, thought my insurance sided with them. By law, isn't that car supposed to be parked outside 5 feet so I can adequately get the hell around it. Should I take them to small claims for damage to my car and premium adjustment. I know this sounds....pathetic. But isn't that the purpose of the 5 foot law, so people can get around it without having to avoid oncoming traffic. I will admit their is No sign or even curb paint to show that it was not allowed to park so close...

Even if the car was parked unlawfully, it does not absolve you of liability. It was there to be seen and under the law it is your responsibility to avoid it.
