Hello, I am in the state of Virginia and was driving along in my SUV and hit by a vehicle on Monday, Feb. 10th. The driver who hit me had a Maryland tag, refused to exchange insurance info with me at the scene prior to the police arriving. The driver was issued a citation for "improper lane change". They basically came into my lane on top of me and my vehicle and my car is damaged according to the adjuster beyond repair. When the police arrived, he gave me her name, telephone number, tag number, and the name of her auto insurance company. I called the auto insurance company and was told by the phone rep that the driver did not have an auto insurance policy with them but did have a home owners policy. I called later again that day and spoke with another rep who said the same thing and after having asked repeatedly if they were sure, they said the same thing - that the driver does not have an auto policy with them. I have been hurting on my left side since. How should I proceed?
