I had a accident in Feb. 2016. The insurance co. had the wrong vin. They have refused to cover my car and the people who hit me. The accident was my fault. What can I do? should I go after the agent for mistakes & omissions?
You need to retain a lawyer to file suit against your agent for errors and omissions AND a declaratory judgment action against for coverage. My guess is that you will need to come up with a substantial retainer fee for expenses.
Note that if coverage has been denied, you may have BMV issues for violation of Ohio's financial responsibility laws.
Perhaps the "easiest" avenue for you would be if your passengers sued you. At that point your insurance company would likely file a reservation of rights and you could then file a third party complaint regarding the coverage issues.
