QUESTION

Is a assignment of benefits legally binding?

Asked on Apr 24th, 2015 on Automobile Accidents - South Carolina
More details to this question:
I was in car accident a year ago. I was at no fault for the accident. The other driver didn't have insurance. I filed a claim with my insurance company for bodily injury. My insurance company wants to settle my claim by paying my hospital bills due to the assignment of benefits I signed while at the hospital. My insurance company advises they are legally obligated to pay my hospital bills and cut me a check for the difference.

If the assignment of benefits is a contract, then it may be legally binding. However there are ways to defeat a contract (i.e. signed under duress, not competent, etc.).
