Is a civil case for wrongful death guaranteed a trial if the two parties can not reach agreement?

Our 16 year old was killed at an underage drinking party .His friend crashed hsi sisters car after leaving the party and on the way back they crashed. The lake where the kids were drinking is man made and is in a private community where the driver lives. The lake has one million dollar liability policy on it.

Yes, provided that a lawsuit is filed within th period of the statue of limitations, a party always has a right to a jury trial. You need not accept a settlement.
