Is an 8% impairment rating normal for ACDF c6/c7?

This is a worker’s compensation question and any help would be greatly appreciated. I was injured at work in 2011. It was an injury to my dominant arm and elbow with numbness in my hand and finger (same arm). I received injections and physical therapy, was sent back to work on full duty (with pain pills). I ended up pulling a muscle in my left shoulder (was on leave a few days), started having neck problems and terrible headaches. Finally an MRI is done which showed herniated disc. Three years after my injury, I received an ACDF to C6/C7 with hardware. I had to have 2 injections into my right shoulder since and expecting another one soon. My FCE rating was 8% BAW with weight limit of 35 lbs. (occasionally). A voc eval was 45%. My gross weekly income before injury was $399. My attorney is estimating settlement at $26,500 with medical left open. This seems very low to me but I'm not knowledgeable in this area. Anyone have any advice, ideas or whatever? I can't provide any specific evaluation without more info. However, generally speaking, if you cannot return to your former employment, but can work elsewhere, you would be entitled to 2/3's of the difference between what you made before and what you can earn now, subject to certain capitated limitations. Have your attorney break it down for you. Get a second opinion, if necessary.
