I was in an accident back in June 2013 that was my fault. I was overwhelmed with many hardships around this time and had overlooked renewing my insurance at the end of May. Needless to say, I was hit with fines totaling $530.00 for no insurance and running a red light. When I went to court mid-October, I was unable to make the payment still. I was told by the judge and given a slip of paper to arrange a payment plan within 45 days, and I should still be able to drive. The following week, I set up a payment plan. My first payment was set for December 1st. I paid $100.00 as my first payment more than a week prior to this date. On Monday, I was pulled over in Cook County, Illinois and arrested for driving on a suspended license. Prior to the arrest, the officer asked me to step to the curb and asked me if I knew why I was being pulled to the curb. I stated that I did not know. I truly had no idea. He said my license was suspended due to failure to pay. Anything I needed to clarify would need to be through DuPage County Clerk. I was given incorrect information from the judge, my "failure to pay" was sent over to the Secretary of State. I thought I did everything right in this situation, and I feel as though I have been set up to fail. Is there anything I can do at this time? What are the next steps that I would have to take? Also, is it not state law that Secretary of State is to reinstate the driver's license of a person whose license was suspended for failure to pay traffic-related fines or penalties if the person enters into a payment plan with a municipality? Or am I taking this out of context? Can I contest the pending charges?
Obviously, something "fell through the cracks" between the Clerk of the Du Page Circuit Court's office and the Secretary of State's office. The pending charges can be contested.
