QUESTION

Is Store Liable for Injury?

Asked on Aug 04th, 2015 on Personal Injury - Wisconsin
More details to this question:
Was in a store an there was water on the floor (did not see water) I slipped on the floor and fell. I did fill out incident report, at the time had a lump and bruise on right foot and banged left knee. Later in the evening had pain on right side from shoulder down...went to see physician and believes I might have lumbar fractures, took x-rays and waiting on results, Dr. has medically excused me from work for several days...still have pain in shoulder and back.

These cases can be very difficult to pursue. Insurance companies routinely deny the claims and force individuals to file a lawsuit; later, at mediation, they will offer "nuisance value" to settle, forcing the person to settle for pennies or go to trial. Unless you have photos of what made you fall or independent witnesses with you, most personal injury lawyers shy away from these type of cases,  unless you have catastrophic injuries.
