Asked on Feb 26th, 2013 on Personal Injury - Florida
More details to this question:
My son just got off the bus and was walking home when he was hit by a car. His foot was ran over and he suffered 2nd degree burns. He has been in so much pain. Does the bus have to wait until the child gets there side of the side walk before they leave? Could the bus be part responsible? What steps should I take?

Yes, the bus company may be liable for negligence depending on the facts. You need to see a good personal injury attorney. I can provide some referrals.

You looking real hard to blame somebody, The bus operator doesn't have any duty that I am aware of to protect your child once he is off the bus.

I am sorry to hear about your son's injuries. It is possible the bus driver an/or the bus company could be liable for negligence. Feel free to contact me if you would like to discuss this matter further.

I can't tell from your description of what happened whether the bus driver could be liable or not. It sounds like maybe the bus took off before your child had completely crossed the street, but I don't know what kind of street. The driver is supposed to wait until the child has crossed before taking off on a 2 way street, but not necessarily on a divided 4 lane. Hope that helps. Good luck.

The school may very well have some liability. I do believe the driver is to wait until the child is completely across the road if the child must cross the road from the road. Contact a personal injury attorney. Contact me if you would like.

You need to contact a personal injury lawyer in your area and sit down and explain what happened. Your description raises more questions than answers and I can't give you any answers without a clear understanding of what occurred. For example, was this a school bus? Is your son a minor? How did he get burns from having been hit by a car? You state that he was walking home, but your description suggests that he was crossing the street. Get a copy of the police accident report. Find out whether there were any video cameras on the bus. Fill out the no-fault paperwork so your son can get the medical treatment he needs.

Why are you not considering making a claim against the driver of the car? Florida law requires drivers to use extraordinary care when they are driving in areas where children are known to be..... (and don't tell me the guy - or gal - couldn't see a big yellow bus - and children are known to be coming out of buses).
