More details to this question:
My wife was rear ended by a vehicle without insurance, we have insurance. Since the vehicle at fault has no insurance, we are having to pay the deductible when we are not at fault and our insurance will probably go up. How is this fair?

Fair or not, thats the situation. If your wife was injured though, she needs to retain a lawyer ASAP to see if she has UM (uninsured motorist) coverage that might pay for pain/suffering etc and she needs to see a doctor ASAP but no more than 14 days from accident for PIP insurance .
