I was in an accident October of this year while on state grounds and clocked in at work and my car was not moving. The other person was at fault but the way the police wrote up the police report he wrote me, and the other person was at fault when that is not true. I was injured in this accident and when I asked the job for the footage, they claimed they don't have it anymore because the accident was over a month and the video overlapped. Now the other insurance is not trying to pay. and if I can't get the state to pay, can I get the insurance or the company the man was working for to pay for something. Because he worked for a vendor of the state not the actual state of Florida.
You should consult with a personal injury attorney here in Florida to review all the facts of your case and explore the possibility of representation on a contingency fee basis. A contingency fee means you pay nothing unless you win. Even though video evidence does not exist, you can still pursue a claim that the other party was at fault for your injuries. Please note that lawyers on this platform are prohibited from soliciting cases, so you would need to research our backgrounds and reach out directly.
Dear Marissa
You may have a 3rd party liability claim for personal injury in addition to a workers' compensation claim. Both claims may be pursued simultaneously. You should consult a personal injury attorney sooner rather than later to avoid potential pitfalls rather than pursuing the matter on your own. Choose an experienced professional for guidance and advice before going further. We all give free consultations and if we take the case, it would be on a contingent fee basis. However, you will have to reach out, as attorneys are unable to directly solicit. Even if it is determined that you do not have a viable personal injury claim, you should speak to a workers' compensation attorney.
