QUESTION

Is this a fair settlement offer?

More details to this question:
Hi, me and my husband were recently involved in a car accident in our business vehicle. I suffered soft tissue damage and contusions and my arm was subsequently put in a sling. I could not use my arm for 2 weeks and was therefore unable to take care of my special needs daughter and had to rely on my family to help me. Now, my arm is in such pain I cannot lift my daughters car seat or stretch without it hurting very badly. I asked the insurance company for 4,000 but they said that was usually reserved for 'small fractures'. My husbands business vehicle was totaled and he went 3 weeks without a replacement one. He suffered whiplash that caused him severe headaches and according to ER X-rays, he also now has a spinal misalignment. His cervical and thoracic spinal area is now shifted to the left of his back from impact. His job involved lifting boxes all day and has been causing him problems. He subsequently has to do home therapy and has to be seen by a chiropractor until the spine is adjusted back into place. The insurance agency has accepted full 100% responsibility. I have been offered $1,000 for pain and suffering as well as $1500 paid directly to my ER medical bills. Is this a good settlement? Should I go to have my shoulder checked first to see if there is something wrong with it? How much should we expect from my husbands injury? This is our first time being in an accident and we have no idea what to expect or know if we are even getting a good deal.

This is a case that really needed an Attorney from the very beginning. The statute of limitations is two years so perhaps a good PI attorney can still straigten this out!! Make an appointment with one in your town as soon as possible.
